Preservation of audiovisual heritage from Argentina: Stress between copyright and distribution in the new exhibition windows

This article discusses the stress between some actions taken by the Argentine government, aimed at preserving the film heritage; and the respect for the copyright of these works. The text discusses two specific cases: the creation of INCAA TV channel and Internet on-demand streaming Odeon, both belonging to the National Institute of Cinema and Audiovisual Arts (INCAA) from Argentina. From the analysis of these cases, and taking as reference the legislation developed by the European Community against this problem, some guidelines are proposed here tending to correct the limitations of the copyright law in force in Argentina regarding the audiovisual preservation field.

Este artículo aborda las tensiones surgidas entre algunas acciones implementadas por el Estado argentino, tendientes a preservar el patrimonio audiovisual, y el respeto de los derechos patrimoniales en torno a estas obras. El texto expone dos casos específicos: la creación del canal de televisión INCAA TV y la plataforma de video a demanda Odeón, ambas pertenecientes al Instituto Nacional de Cine y Artes Audiovisuales (INCAA) de Argentina. A partir del análisis de estos casos, y tomando como marco de referencia la legislación desarrollada por la Comunidad Europea frente a este problema, se ofrecen propuestas tendientes a subsanar las limitaciones producidas en el campo de la preservación audiovisual por la legislación sobre derecho de autor vigente en el país.
